This luxury cruiser ran aground on a St Kilda breakwater in the early hours of Saturday 27th November.
It is alleged the driver was intoxicated while operating the 33ft Flybridge Cruiser and didn't see the navigation beacon or the rock wall and ran aground at speed.
A 36-year-old man was maimed unconscious during the accident, while the driver managed to call emergency services.
Local Water Police responded to the call from their base in nearby Williamstown around 4am.
They rescued both men from the wreck before breath testing the driver.
Police said his initial blood-alcohol reading was above .05 and charges are expected to be laid.
Onlookers who gathered around the breakwater thought it was a result of the stormy weather that pelted the state.
